MONITORING AND ENFORCEMENT PROCEDURES OF JAKIM

Types of Malaysian Halal Certification offenses


1.1 Light Offenses -  An offense involving non-conformance to the following:

i. Clean premises
ii. Clean equipment
iii. Clean workers
iv. Clean environment (no good maintenance of sanitary)
v. No pest control
vi. Other errors related to hygiene and sanitation
vii. Food handlers do not receive immunization against Thyphoid
viii. Cooking / bringing in food and other beverages into the processing area
ix. Failure to submit the required documents inspection
x. Change / addition of ingredients that manufacturers have halal certification without informing writing to JAKIM / JAIN / MAIN

ACTION:
Halal certificate holders (SPHM) will be warned and instruction / corrective action to be taken as directed.

1.2 Heavy Offenses - An offenses involving the following items:

i. Change / addition of the supplier / manufacturer of ingredients that do not have halal certification from JAKIM or JAIN / MAIN or any recognized halal certification body.
ii. Using the Malaysian halal logo on products that are not found in SPHM
iii. Falsification or misuse of the Malaysian halal certification or logo
iv. Lend / submit the original halal certification to other premises or other companies
v. Modify the information contained in SPHM
vi. Change or add any ingredients that have been declared in the application form without written permission from JAKIM / JAIN / MAIN
vii. No employee of the Muslim citizens of Malaysia at least 2 (two) in the processing area / kitchen
viii. Using and displaying an expired halal certification
ix. Device or elements of religious worship located in the processing / kitchen
x. Animals roaming in the premises area
xi. There are workers living in the area of ​​the premises
xii. Does not comply with any of Malaysia's related halal standards
xiii. Failure to comply with the correction of small offenses.

ACTION:
Holders will be subject to action of suspension of their SPHM to get a verdict from the Halal Certification Panel.

1.3 Serious Offenses - An offense involving the Islamic law principles and technical aspects as follows:

1.3.1 Offences involving Islamic law:
i. Authentication of Non-Halal status of products / materials ingredients / equipment by a recognized religious authority agreed by the Panel Halal Certification
ii. The use of ingredients not permitted after having SPHM
iii. Storage of halal ingredients with non-halal ingredients in the same place
iv. Keeping halal products with non-halal products in the same place
v. Hardware / Equipment used promiscuously between halal and non halal
vi. Processing of imperfect slaughtered live stocks or that are not totally dead
vii. Stunning use of animals causing death or mazbohah
viii. Bringing in materials not permitted to the premises or company that has received SPHM

1.3.2 Offences involving the technical aspects:
i. Moving premises or the factory without informing JAKIM
ii. Change management and company names without informing JAKIM
iii. Butcher and checker does not have the credentials / letters of authorization to slaughter
iv. Butcher and checker using an expired credentials / letters of slaughter authorization
v. Stunning use not following the standard set
vi. Stunner controlled by non-Muslim workers
vii. Using prohibited substances that are enforced in any relevant Act / Laws

ACTION:
SPHM holder shall be liable for their SPHM to be withdrawn by the examiner and will be submitted to Halal Certification Panel for final decision.
